Internet Gambling Jurisdictions Update
The UK Gambling Bill was published on October 19 2004.The gambling bill will allow operators of casinos and poker sites to be licensed in the UK for the first time, but the fine details of the remote gaming licences remain less than clear. The second reading of the Gambling Bill passed 286 to 212 on Nov 2, however, Tessa Jowell, the Culture Secretary, is likely to announce changes during the Bill's committee stage.
Said Musa, the Prime Minister and Minister Responsible for Gaming Control in Belize, has approved new gaming regulations. There are adjustments to the online gaming regime for a more efficient processing and monitoring capacity, in addition to a reduction of licensing fees.
In a ruling that could open the US to offshore Internet gambling, a World Trade Organization panel that met Nov. 10 in Switzerland said Congress should drop prohibitions on Americans who place bets through online casinos. In its final 287-page report, the WTO panel confirmed the preliminary ruling in March in a dispute that pits the U.S. against Antigua and Barbuda. The report says the ban represents an unfair trade barrier. The U.S. has 60 days to file an appeal to WTO trade judges, who then must issue a final ruling within three months.
The United States Department of Justice on Nov 6, 2004 filed a motion to dismiss a case in which an Internet portal site has asked the court to protect what it believes is its constitutional right to carry advertisements for online gambling services. In August, Casino City filed a case seeking declaratory judgment that advertising for online casinos and sports books is free speech under the First Amendment of the United States. The Justice Department maintains that the First Amendment does not protect commercial speech related to illegal activity, which it deems remote gambling to be.
The National Gaming Board is threatening to close gaming companies’ Swedish offices following a ruling in the Supreme Administrative Court that the Swedish gaming monopoly does not violate European regulations.
